ERISA Laws
The Employee Retirement Income Security Act (ERISA) of 1974 is a US federal statute that allows almost all employees to enjoy different types of private welfare benefits like life insurance, disability insurance, health insurance, pension, severance pay, and others. ERISA was enacted mainly to provide pension coverage for employees after a specified minimum number of years of tenure, but has been amended from time to time to include other private employee benefits.
Although ERISA laws do not require all employers to provide these benefits to their employees, it regulates the manner in which such benefits operate, and the manner in which an employee can obtain vested rights to a pension.
When employers set up benefits for their employees, they will usually provide an ERISA summary plan description document which outlines the terms of the ERISA plan or the insurance policy that provides you the private benefits. It provides detailed information about the coverage, exclusion and limitations of the said plan.
ERISA laws are considered safety nets for the protection of working person's rights. Most of the insurance benefits are provided through group insurance policies sponsored by private employers, but insurance companies nowadays usually deny employees of these benefits, With ERISA laws, a wrongful denial can result to a court verdict awarding the pensioner with denied benefits and compensation for damages.
If you think your insurer's denial is wrong, you have the right to file a lawsuit for violation of ERISA laws. But due to the complicated process of court proceedings regarding burden of proof for claimants, you might lose in this legal battle. It is best that you consult with an ERISA lawyer who actually has expertise with cases regarding denials of benefits covered by ERISA.
